This is an appeal by the defendants, three in num ber, from a judgment of the circuit court which is based upon findings of fact and conclusions at law. The judgment, after holding that the plaintiffs were the owners of and entitled to the possession of a parcel of real property, one acre in extent, which is described in the complaint, awarded its possession to them.

The appellants’ brief, under the heading of Points and Authorities, submits the following two propositions :
