MEMORANDUM OPINION
MOON, District Judge.
Pamela Capps filed this action under Title VII of the Civil Rights Act of .1964, 42 U.S.C. § 2000e et seq., alleging that she was wrongfully discharged by defendants 1 as the result of racial discrimination. Defendant Lynchburg School Board filed a motion to dismiss for lack of jurisdiction pursuant to Fed.R.Civ.P. 12(b)(1), as well as a motion to dismiss for failure to state a claim pursuant to Rule 12(b)(6). Alternatively, defendant moves the court for summary judgment under Rule 56. For the reasons set forth below, defendant’s motions are DENIED.
