OPINION

MOON, District Judge.

Plaintiff Larry Wayne Nash filed this wrongful termination action under the Americans with Disabilities Act of 1990, as amended, 42 U.S.C. § 12101, et seq. Defendant D.S. Nash Construction Company filed a motion to dismiss for lack of subject matter jurisdiction pursuant to Rule 12(b)(1) of the Federal Rules of Civil Procedure. Because this Court has subject matter jurisdiction over plaintiffs claims, defendant’s motion is DENIED.
