Originally instituted in the Circuit Court of Upshur County, West Virginia, the above-styled civil action was removed by defendant Philadelphia Life Insurance Company (“PLI”) on the basis of federal question jurisdiction and, alternatively, diversity jurisdiction. Defendant PLI filed a Notice of Removal on August 31, 1992, which represented that defendant Professional Benefits Consultants, Inc.
