MEMORANDUM AND ORDER
YOHN, District Judge.
Pending before the court is plaintiffs motion to remand this action to the Philadelphia County Court of Common Pleas. For the reasons discussed herein, his motion will be granted.
BACKGROUND
On January 14, 1994, plaintiff Calvin Ogle-tree, III, formerly employed by'the City of Philadelphia as a police officer, instituted this action in the Philadelphia County Court of Common Pleas against twelve defendants: Amos Barnes, plaintiffs dentist; Audrey Wright, Barnes’ assistant; the City of Philadelphia and five individual members of the Philadelphia Police…
