PROCEDURAL BACKGROUND
Plaintiff, IMS Services, Inc. (IMS), initially filed this action on October 26, 1994, seeking declaratory and injunctive relief. The lawsuit arose following a decision by the defendant, United States, acting through the Department of the Navy, to reopen competition on Solicitation No. N68936-93-R-0172, after the selection of the plaintiff as the successful offeror and after issuance of a signed contract document to the plaintiff on May 2, 1994.
