Appeal by the defendant from a judgment and from an order denying his motion for a new trial. .

The case involves a contract for the sale of two cargoes of coal by the plaintiff to the defendant. The plaintiff was a merchant doing business in London, England, and the defendant was engaged in the coal business in San Francisco. The contract was made by cable. The defendant in the course of his business as a coal-shipper had adopted a certain form of charter-party for the shipment of coal upon vessels.
