Tried by special court-martial, the accused pleaded guilty to a charge of absence without leave, in violation of Uniform Code of Military Justice, Article 86, 10 USC § 886, breach of restriction, in violation of Code, supra. Article 134, 10 USC § 934, and to the *253lesser included offense of wrongful appropriation involved in a charge of larceny, in violation of Code, supra, Article 121, 10 USC § 921.
