Accused was tried by a special court-martial on a specification charging failure to obey a lawful order, in violation of Article 92, Uniform Code of Military Justice, 50 USC § 686. He was found guilty and sentenced to a bad-conduct discharge, confinement for three months, forfeiture of $25.00 per month for a like period, and reduction in grade to that of seaman recruit. The officer exercising supervisory authority reduced the confinement and forfeitures to two months, but otherwise approved the findings and sentence. The board of review held the…
