I. INTRODUCTION

This Bivens 1 action comes before the court on the defendants’ motion to dismiss pursuant to Federal Rule of Civil Procedure 12(b)(1), (3), (4) and (6). The pro se plaintiffs, Stephen Freeman and Lorraine Fairchild (“the plaintiffs”), are former criminal investigators with the Office of the Inspector General (“OIG”) of the United States Environmental Protection Agen cy (“EPA”).
