MEMORANDUM OPINION
SCHATZ, District Judge.
This matter is before the Court on defendant’s motion for summary judgment (Filing No. 16). On October 30, 1984, a hearing was conducted on such motion at which oral argument was presented by the respective parties. After review of the pleadings, briefs and other documents filed in support of and in opposition to said motion, the Court concludes that defendant’s motion for summary judgment is well taken and should be granted.
