Plaintiff, Betty Earls, appeals by right from an order directing a verdict against her both individually and in her capacity as next friend of Raymond Earls in an automobile negligence action. The basis of the order was that neither Betty Earls’ nor Raymond Earls’ injuries satisfied the threshold requirement of "serious impairment of body function” or "permanent serious disfigurement” imposed by the no-fault act as a condition precedent to a finding of tort liability of defendants Herrick and Reilly.
