Defendant was tried and convicted for the violation of the Blue Sky Law and sentenced to a term in the state penitentiary. Defendant appeals.

Defendant and four others were indicted charged with a violation of § 25-1325, Oregon Code 1930. The indictment charges the defendant with unlawfully devising a scheme to defraud in the sale of securities and committing an overt act in furtherance thereof.
