Nichols, Judge:

The merchandise involved in this case is described on the invoice as “Niveaux d’atelier en coffret metal” (shop levels in metal box). It was imported from France and entered at the port of Philadelphia on July 13, I960.1 It was assessed with duty at 50 per centum ad valorem under paragraph 228(a) of the Tariff Act of 1930, as modified by the Torquay Protocol of Terms of Accession to the General Agreement on Tariffs and Trade, T.D. 52739 and T.D. 52820, as optical measuring or optical testing instruments, frames and mountings, and parts, finished or unfinished.
