Defendant, Western Pacific Insurance Company, appeals from an order granting plaintiff’s motion for summary judgment and dismissing defendant’s motion for summary judgment.

Plaintiff, Thomas A. Murray, through his guardian ad litem, brought a declaratory judgment action against defendant seeking coverage under an automobile insurance policy issued by defendant to the owner of a vehicle in which plaintiff was riding when he suffered bodily injuries as the result of a collision.
