This is an appeal from an order of the Appellate Division for the Northern District, dismissing a report established by a judge assigned for that purpose under Rule 30 of the District Courts (1932) as amended.

The action is in tort to recover for personal injuries, sustained by the plaintiff in falling on a common stairway of a two-tenement house owned by the defendants in which the plaintiff’s husband was one of the tenants.
