This is an appeal from an order denying plaintiff's petition to enforce the payment of a judgment. The appeal is upon an agreed statement.

In February, 1933, the California Mutual Building and Loan Association became insolvent and was taken over by the state Building and Loan Commissioner (a successor commissioner is defendant herein) and since that time has been in the process of liquidation. In December, 1933, plaintiff commenced an action against the association and commissioner to recover for services rendered to the association.
