Plaintiff appeals from an order granting defendant’s motion for summary judgment and from the summary judgment in favor of defendant entered pursuant to said order. While the summary judgment “is an appealable judgment as in other cases” (Code Civ. Proe., § 437e) the order granting the motion for summary judgment is merely a nonappealable preliminary order (3 Witkin, Cal. Procedure (1954) p. 2160 ; Integral Land Corp. v.
