The government has moved for reconsideration of the post-trial judgment entered October 16, 2007 in this contract case involving spent nuclear fuel (“SNF”). Judgment was entered on the basis of the court’s decision rendered on that same day. See System Fuels, Inc. v. United States, 79 Fed.Cl. 87, 2007 WL 3033659 (Oct. 16, 2007) (“System Fuels III”). The government’s motion raises two issues that merit discussion.
