This appeal is taken by defendant as administratrix of her mother’s estate from a judgment for plaintiff in an action brought by him upon a claim of title to real property.
On May 24, 1932, 0. P. Borden, Sr., a widower, entered into a written agreement with his sister Arabelle Stronaeh, a widow, whereby Mrs. Stronaeh agreed to execute a grant deed to her brother covering property on which she resided at Hermosa Beach upon the consideration that he advance her at any time or times, within his sole discretion, various amounts of money up to the sum of $3,000.
