By his petition for a writ of habeas corpus petitioner alleges that he is now unlawfully imprisoned and restrained of his liberty by the warden of Folsom penitentiary in that he has served the maximum term of imprisonment as provided by law on the legal portion of the judgment under which he was committed.

The information to which petitioner pleaded guilty and under which he was adjudged to be an habitual criminal, charged him with the commission of a prior felony in the State of New Mexico, for which he was convicted and served a term in prison in that state. Respondent concedes that the New…
