The defendant is the county auditor of Sam Joaquin County. The petition prays that a writ of mandate-issue from this court directing the defendant, as such auditor, to draw a warrant on the county treasurer in favor of petitioner for the amount of a certain claim allowed by the board of supervisors of the county payable out of the “highway improvement fund” for work done in the construction of a. road in said county in performing a contract made by the board of supervisors with the petitioner under the provisions of the statute of March 19, 1907, known as the “Good Roads Law” (Stats. 1907, p.…
