{¶ 1} Plaintiffs-appellants, Frank Circelli (individually, “Circelli”) and his wife, Barbara Circelli (jointly, “plaintiffs”), and defendant-appellant, Truberry Group (“Truberry”), have filed a joint appeal from a judgment of the Franklin County Court of Common Pleas, granting the summary judgment motion of defendant-appellee, Keenan Construction (“Keenan”). In addition, Truberry appeals from the denial of its motion for summary judgment. Because a genuine issue of material fact precludes summary judgment to Keenan, we reverse that aspect of the court’s judgment. Because the…
