The trial of this action having resulted in the direction of a verdict for defendant, plaintiff appeals from the order denying his motion for new trial.

Plaintiff declared on two causes of action: First, on a written contract of January 17, 1928, whereby defendant, inventor and owner of a valuable secret remedy “known as Pfunder’s Stomach Tablets,” promised plaintiff a commission of $100,000 for procuring “a person, persons, or corporation that is willing and able to purchase” the remedy and all rights therein for $1,000,000.
