MODARELLI, District Judge.

This action brought by Modern Art Printing Company, a partnership composed of Joseph Bardash and Percy Rimes, against Arthur N. Skeels and Alice M. Skeels, individually and as co-partners doing business under the firm name of Art Roll Leaf Stamping Company, seeks to enjoin an alleged infringement of Patent No. 2,491,947 applied for on June 11, 1948 by Bardash and issued to Bardash (assignor to Modern Art) on December 20, 1949.
