— The appellee, as plaintiff, commenced this action against the appellants, as defendants, in the court below, on the 16th day of July, 1873.

In his complaint, the appellee alleged, in substance, that *511the appellants, Marcus Leonard, Thomas Leonard, Caroline Ellis, Jonathan "W\ Ellis and Russell R. Leonard, were the children and heirs at law of one James R.
