Appellants sued the appellees. Demurrers *142filed by part of the defendants to the complaint were sustained. The plaintiffs declining to amend the complaint, judgment was rendered for the defendants. The only question presented here is the question as to the correctness of this ruling. In the first paragraph of the complaint it is alleged that on the 8th day of May, 1856, James Davis died intestate, seized-in fee simple of certain real estate, which is described in the complaint, and the equitable owner, by title bond, of certain other real estate, the legal title to which was afterward conveyed…
