The record of this cause was filed in this court on the 18th day of August, 1877, more than four years after the act of March 6th, 1873, inter alia, abolishing courts of common pleas, became a law of this State. It appears from this record that at the March term, 1869, of the court of common pleas of Union county, Louisa J. J oh n son, administratrix of the estate of Robert B. J ohnson, deceased, presented to the court her verified petition, in which she alleged, among other things, that there was a probable deficit of the personal property belonging to said *290decedent’s estate, wherewith to…
