BROCK, Chief Justice.

The trial court dismissed the plaintiff’s action for workmen’s compensation benefits and he has appealed.

The employee, Gordon Bell, received injuries when he was stabbed with a knife by Andy Finkston at a motel in Knoxville on October 17, 1977. The employer, Kelso Oil Company, shortly prior to that time, had purchased another enterprise, the Trimble Oil Company. The plaintiff, Bell, had been a salesman for Trimble and witness Ron Mason had been a salesman for Kelso Oil Company, but following the merger both men were employed by Kelso.
