Defendant, Herbert Bowens, appeals from the judgment denying his Rule 29.15 motion without an evidentiary hearing. We affirm in part and reverse and remand in part.
A jury convicted defendant of two counts of rape, section 566.030, 1 one count of Mdnapping, section 565.110, and one count of deliberately creating a grave and unjustifiable risk of infecting another -with HIV, section 191.677.1(2).
