This is an appeal from an order of the district court denying plaintiff's motion to amerce the defendant, as sheriff of Richland county, for failure to make or file a return of an execution issued on a judgment in a foreclosure proceeding against the defendant Wright, and others.

The facts necessary to an understanding of the issue presented are substantially as follows: On May 1, 1925, a default judgment was entered in favor of the plaintiff and against the defendant Wright by default for the foreclosure of a mortgage.
