JAMESON, District Judge.

These two actions, consolidated for trial, are prosecuted under the Federal Tort Claims Act, 28 U.S.C. §§ 1346(b) and 2671-2680, inclusive, for damages for personal injuries sustained by the plaintiffs on June 6, 1959, as the result of a collision at the intersection of 1st Avenue South and South 34th Street in the City of Billings, Montana, between a mail truck owned by the defendant and operated by William Folkerts, and a motor bike being driven by the plaintiff Janice Marian Chavez on which the plaintiff Darryl Sorenson was riding.
