Plaintiff brought this action against the defendant Hanson, sheriff óf Foster county, and the State Bonding Fund, as surety on his official bond to recover damages claimed to have been sustained by the plaintiff by reason of the failure of the said sheriff to sell certain personal property levied upon under an execution. The complaint alleges that the defendant Hanson, at the time in question, was the sheriff of Foster county and that pursuant to the laws of this State the defendant, State Bonding Fund, had agreed to indemnify the public and individuals against the failure of official duty on…
