On August 23, 1923, this action was instituted by the plaintiffs to recover the sum of $12,500 damages because of alleged fraudulent misrepresentations made by the defendants, relied upon by the plaintiffs in the purchase of certain agricultural lands in Judith Basin county. On a former appeal the sufficiency of the complaint was sustained. (Ray v. Divers, 72 Mont. 513, 234 Pac. 246.) Subsequently, upon issue joined by answer and reply, the cause was tried to the court sitting with a jury.
