Tbe collision occurred about five o’clock on tbe afternoon of 21 June, 1949, wben tbe automobile in wbicb tbe plaintiff was riding was struck by tbe defendant’s southbound passenger train near Pembroke, North Carolina. Tbe plaintiff was riding witb ber busband, Zeb Jones, in bis car, returning along a country road to tbeir borne. At a point about a mile and a quarter from tbeir bouse, tbe road over wbicb tbey were traveling crosses tbe main nortb-soutb double line tracks of tbe defendant railroad about balf a mile south of Pembroke.
