The plaintiff appeals from a judgment entered against him after the trial court sustained a demurrer without leave to amend. The complaint on file seeks to recover certain payments made under a conditional sale contract for the sale of a certain truck. Recovery is sought of all the installment payments made by plaintiff to defendants before the payment of the balance of the entire purchase price of the truck was paid off in full prior to final maturity of the contract of sale covering the truck.
