Appellant, an attorney with many years of experience, represented Walter Crutchfield, who, in May 1986, was indicted on controlled substance and racketeering charges. Crutchfield was tried before District Court Judge Stephen Huffaker beginning on December 5, 1988.

During the trial, appellant and Judge Huffaker clashed repeatedly. According to appellant, Judge Huffaker exhibited hostility and contempt toward the defense team.
