THE COURT.

This is an application for a writ of prohibition to prevent all of the judges of the superior court of San Diego County from proceeding in a certain cause pending in that court wherein the city of San Diego is plaintiff and the petitioners herein are defendants. The sole ground for the application is the claim of a disqualifying interest possessed by the respondent judges under subdivision 1 of section 170 of the Code of Civil Procedure, which provides that no judge shall sit or act in any action or proceeding “in which he is interested.” A general demurrer has been interposed to…
