While he was a member of the Los Angeles Board of Education appellant was indicted on three counts, each accusing him of having an unlawful interest in a contract executed by the board. Count I alleged a contract between the board and the Jack and Jill Ice Cream Company, a partnership herein referred to as Jack and Jill, and that it was contrary to the provisions of section 1011 of the Education Code and section 1090 of the Government Code.
