The City of Marysville, in the month of September, 1879, commenced- an action in the then District Court of Yuba County, over which the Hon. Philip W. Keyser presided, against the present petitioner and numerous other mining corporations and individuals-—-the complaint alleging, among other things, in substance, that the plaintiff is, and since the 3d day of February, 1851, has been, an incorporated city, embracing within its limits about three thousand acres of land, of which it owns and controls the city cemetery, containing about fifteen acres; the fair grounds, containing…
