C. G. Colvin filed an action in the district court of Creek county against hisi employer, S. W. Anthony, to recover damages for personal injury alleged to have been suffered in the course of his work as a result of the negligence of the master. Plaintiff alleged that the defendant did not carry workmen’s compensation insurance as required by law and by virtue of section 13352, O. S. 1931, 85 O.S.A. § 12, he was authorized to sue in a civil action to recover his damages.
