Reversing.
The grand jury of Jefferson county on June 15, 1938, returned an indictment against George Blusinsky' charging him with the crime of unlawfully and feloniously receiving stolen property of the value of more than $20. At the trial held December 5, 1938, the jury returned a verdict of guilty, and fixed the defendant’s punishment at confinement in the state penitentiary for a period of two years. On December 7, 1938, the defend ant moved the court to withhold the rendition of the judgment, and the following order was entered:
