Reversing.

Maynard Lovelace, a deputy sheriff of Lee County, killed Jake Brandenburg while endeavoring to arrest him on November 21, 1936. The next ensuing grand jury declined to return an indictment against Lovelace. A subsequent grand jury indicted him and he was convicted thereunder of voluntary manslaughter and sentenced to five years’ imprisonment.
