Pursuant to Rule 56.1 of the Rules of this Court, plaintiff Sheree E Henderson, a former employee of Hawkins Oil and *127Gas, Inc. (“Hawkins”), moves for judgment upon the agency record challenging the most recent determination by the United States Department of Labor (“Labor”) in Hawkins Oil and Gas, Inc.; Tulsa, OK; Negative Determination on Reconsideration (“Negative Determination”), 57 Fed. Reg. 10,924 (1992).
