I. introduction

This case is before the court on Plaintiffs’ motion for judgment upon the administrative record pursuant to USCIT Rule 56.1(c)(1). Plaintiffs seek judicial review of the Secretary of Labor’s (the “Secretary” or “Labor”) denial of certification for trade adjustment assistance (TAA) under Section 222 of the Trade Act of 1974, (the “Act”), as amended and codified at 19 U.S.C. § 2272 (1994).
