Paul W. Brosman, Judge:

The accused was convicted, following trial by general court-martial convened at Fort Lewis, Washington, of assault with intent to commit voluntary manslaughter, in violation of Article 134, Uniform Code of Military Justice, 50 USC § 728. He was sentenced to receive a dishonorable discharge, as well as to total forfeitures and confinement at hard labor for one year. The convening authority suspended the execution of the punitive discharge, but otherwise approved the findings and sentence. The board of review affirmed, and the case is before this Court…
