OPINION

BURKE, Justice.

This is an appeal from a grant of summary judgment in a civil action brought by Ordie Coney against the Municipality of Anchorage and police officer Mark Head-lough. Coney sued for injuries sustained during his arrest for robbery. Coney was injured when Headlough’s pistol discharged.

In his prosecution for robbery, Coney moved to suppress all evidence seized during the arrest, including his identity, on the ground that Headlough used excessive force. Coney, however, did not testify at the suppression hearing. The court found that the force used was not excessive and…
