OPINION

FUTEY, Judge.

This government contract case is before the court on cross-motions for summary judgment. Plaintiffs contracted with the United States Postal Service (Postal Service) for the construction and lease of a facility to serve as an annex for mail carriers in Charlotte, North Carolina (“09/10 Annex”). Defendant entered the premises of the 09/10 Annex and continues to occupy them, but refuses to tender the agreed rent.
