Specialist Michael A. Garner, contrary to his pleas, was found guilty at a general court-martial with members of: rape, forcible sodomy, and indecent assault of his biological daughter; possessing child pornography; desertion; and disobeying a no-contact order. Articles 120, 125, 134, 85, and 90, Uniform Code of Military Justice (UCMJ), 10 U.S.C. §§ 920, 925, 934, 885, 890 (2006). The convening authority approved the adjudged sentence of reduction to E-l, forfeiture of all pay and allowances, confinement for life, and a dishonorable discharge.…
