WEICK, Circuit Judge.

Severance Specialty, Inc. [Severance] appealed from a judgment entered upon a jury verdict in the District Court awarding $40,000 to plaintiff, Judy Hruska, in her action for malicious prosecution.

Severance was responsible for having the plaintiff prosecuted for shoplifting. After her acquittal of charges of larceny in the state court, she filed suit against Severance in the District Court to recover $250,000 damages.

Jurisdiction was based on diversity of citizenship. 28 U.S.C. § 1332. Mrs. Hruska was a resident of Florida when she filed the suit, and Severance was an…
